OVERVIEW
The Unilever URewards Program is operated by Unilever Australia Limited ("Unilever"), as an incentive program for eligible employees to meet sales targets set by Unilever management. The terms and conditions on which the Unilever URewards Program is offered are set out below:

1. Eligibility

To be eligible to participate in the Unilever URewards Program, the Participant must be a PERMANENT WORKLEVEL 1 EMPLOYEE OF UNILEVER AUSTRALIA LIMITED, WORKING AS A TELESALES OPERATOR (WORKLEVEL1A), SALES EXECUTIVE (WORKLEVEL 1B), BUSINESS DEVELOPMENT REPRESENTATIVE (WORKLEVEL 1C) or CALL CENTRE MANAGER (WORKLEVEL 1D) IN THE OUT OF HOME BUSINESS (OOH)

For the avoidance of doubt, the following employees are not eligible to participate in the Unilever URewards Program:

  • casual employees in OOH;
  • permanent employees in OOH who are head office based other than the CALL CENTRE MANAGER and Telesales Operators
  • permanent employees in OOH who are Worklevel 2 and above
  • all Unilever employees not employed in OOH; and
  • all employees of Unilever New Zealand Limited.

Eligible employees will cease to become eligible if and when they cease to meet any of the eligibility requirements in this clause 1, including if the employee:
  • leaves the employ of Unilever for any reason;
  • is promoted or accepts a position outside of OOH
  • is promoted or accepts a position within OOH other than the positions of: TELESALES OPERATOR, SALES EXECUTIVE, BUSINESS DEVELOPMENT REPRESENTATIVE, CALL CENTRE MANAGER or WL2 or above;
  • accepts a casual Unilever position.


2. Enrollment

Each eligible employee will be automatically enrolled as a Participant in the Unilever URewards Program and will be assigned a user login and password to gain access to the Unilever URewards Program website. Upon initial login, Participants are required to change their personal password.

If a Participant ceases to be an eligible employee, his or her enrolment will be automatically cancelled:
  • immediately if the employee ceases to be a Unilever employee; or
  • if the employee remains a Unilever employee, 30 days from the date upon which the Participant ceases to be an eligible employee.


3. Application of the URewards Program

URewards is the individual component of Variable Pay where eligible employees can earn up to 8% of their notional salary in a calendar year through achievement of the 3 annual targets.

How does it work?
Each eligible employee has three annual targets. These annual targets are broken down into monthly targets which are allocated a percentage weighting. Each month an employee has three separate monthly targets that they are tasked with achieving.

If the employee achieves a monthly target they will earn a predetermined percentage of salary (notional) as calculated according to the weighting of the target. If the employee does not achieve a monthly target they will earn zero percentage for that monthly target. At the end of a calendar year, the total earnings will be payable in April the following year subject to the terms and conditions of this program and the Unilever Worklevel 1 Variable Pay Policy.

Eligible employees can log on each month to view monthly targets, performance against these targets and the earnings that they have accrued so far. The employee can also view what they can potentially earn until the end of the year.

Any dollar value given in the website is based on a TGR value that the employee inputs. This dollar value will not reflect the real dollar value as it is dependent on the employee entering the TGR correctly. The payment made to the employee will be entirely based on the true TGR as recorded in the Unilever payroll system.

The percentage of notional salary payable remaining at the termination of the Unilever URewards Program or at the cancellation of the Participant's enrolment in accordance with clause 2 will be paid out according to the Variable Pay policy.

4. Timing of pay-out

The Participant's Unilever URewards Program awards will be paid out in line with Unilever's VP policy in April of each year.

5. Fraudulent Claims

Participants are required to enter data into the handheld IPAQ during each customer visitation. If any participant is found to have deliberately entered false or misleading data into the IPAQ the participant will undergo disciplinary action which may result in the instant termination of the participant's employment.

6. The Unilever URewards Program

Unilever reserves the right to suspend or terminate the Unilever URewards Program at any time by giving 1 months notice to Participants via the Website or via Unilever.com email address. All Targets achieved will be paid out in line with Unilever's Variable Pay policy.

7. Spin-n-Win Rewards

Participants will receive one Token for every monthly target achieved to participate in the SPIN-N-WIN section of the Website. The Participant's account will be automatically updated every time the Participant receives a Token. Tokens cannot be sold, assigned, or otherwise redeemed except in accordance with these Terms and Conditions.

Participants may use the Token to spin the wheel for a chance to win a instant prize (valued at $ 50 RRP). All Participants that spin the wheel and receive a draw card will be placed in the annual SPIN-N-WIN at the end of each year for the Participants chance to win the grand prize (valued at $ 500 ) which changes each year, see the current Spin-2-Win page of the website for more information. The winner will be notified by phone and the winners details will be published on the Website on 1 February. Unilever's decision is final and no correspondence will be entered into.

The annual SPIN-N-WIN will be drawn at 16.00 AEST on 31/01/2008 at Unilever Australasia 20 Cambridge Street, Epping 2121. Where the prize is unavailable for any reason, Unilever reserves the right to substitute for that prize another item of equal or higher value as determined by Unilever. No responsibility is accepted for any variation in the value of the prize. Prize value includes GST where applicable. The prize or any unused portion of the prize is not transferable or exchangeable and cannot be taken as cash.

Prizes must not be sold or otherwise transferred by the eligible employee to any other person, or used for promotional or commercial purposes without Unilever's prior consent. If a prize is sold, transferred or otherwise used in breach of this condition, Unilever reserves the right (without limiting its other rights) to cancel the prize or to refuse to provide the prize to the person to whom any sale or transfer (or purported sale or transfer) has been made.

The Participant cannot redeem any prizes, including vouchers, for cash, cheques, money orders or other payment instruments.

Any prize which is damaged or defective, delivered after its "use by" or "best before" date needs to be reported to the URewards Incentive Scheme Administrator no later than 48 hours after delivery.

8. Disclaimer

Unilever makes no warranties in relation to any prizes supplied to Participants under the Unilever URewards Incentive Program, and excludes any and all liability in relation to the prizes, other than any warranties and liability which cannot be excluded by law ('Non-Excludable Conditions').

In relation to any Non-Excludable Conditions, to the extent permitted by law, Unilever limits its liability to:
  • where the Prize is a good - repair or replacement of the goods or the cost of repairing or replacing the goods; or
  • where the Prize is a service, supplying the service again or payment of the costs of having the service supplied again.


9. FBT-Personal Income Tax Information

Please note that the grand prize of the annual SPIN-N-WIN given outside of the Payroll System are subject to Fringe Benefits Tax and may be Reported on employees' PAYG Payment Summary (group certificate) as a Reportable Fringe Benefit Amount (RFBA).

Participants need to be aware that acceptance of a grand prize under the Unilever URewards Incentive Program may have implications for their personal situation.

RFBA's are used when assessing entitlements to a variety of income-tested Government Benefits, Child Maintenance Payments, and liability to income-tested surcharges, such as Medicare levy surcharge, concessions for personal and spouse superannuation contributions and HECS debt repayments.

Participants must ensure that they have considered any impacts participation in the Unilever URewards Incentive Program may have on their personal situation.

10. Privacy Notice

The Unilever URewards Program Website is housed and operated by Online-Rewards, Whapps, LLC dba Online-Rewards (The Licensor), 3102 Maple Ave, Suite #450 Dallas, Tx 75201, on behalf of Unilever. The information collected on this web site will be used by Unilever in connection with the Unilever URewards Program and will not be provided to any person outside Unilever, without first obtaining the Participant's approval to do so. Unilever collects personal information from the Participant in order to conduct the Unilever URewards Program. The collection and use of the Participant's personal information shall be strictly in accordance with Unilever's Privacy Policy posted on the Website. The Privacy Policy can be found also at http://www.unilever.com.au/resources/privacy.asp

11. Confidentiality

If the Participant uses this web site, the Participant is responsible for maintaining the confidentiality of the participant's login and password and for restricting access to the Participant's computer. It is a condition of participation that Participants accept responsibility for all activities that occur using that Participant's login and password.

12. Changes to the Scheme and these Terms and Conditions

Unilever may change, amend or vary these Terms and Conditions at any time. The Participant agrees that the Participant will be bound by any change to these Terms and when the Participant first participates in the Unilever URewards Program after the change has been effected.

13. General

These Terms and Conditions shall be governed by and construed in accordance with the laws in force in New South Wales.

14. Variable Pay Policy

These Terms and Conditions shall be governed by Unilever's Variable Pay Policy. This policy is located on the Unilever Intranet site "The Planet". By agreeing with the terms and conditions of this Program you accept that you have read and understand the Unilever Variable Pay Policy and it's application to the URewards Program.

15. Interpretation

In these Terms and Conditions:

"Participant" means an eligible employee who has been enrolled into the Unilever URewards Program in accordance with these Terms and Conditions.

"Tokens" means the credits allocated to a Participant for use in connection with the SPIN-N-WIN section of the Unilever URewards Incentive Program.

"Unilever" means Unilever Australia Limited, ABN 66 004 050 828, 20 Cambridge Street Epping NSW 2121
